The right approach depends on what you want your agent to handle, how long the authority should last, and whether it should remain effective after incapacity. Health care decisions require a separate California document.

Financial Power of Attorney

A financial or property power of attorney can authorize an agent to manage selected banking, bill payment, tax, real estate, or other property matters. Its terms should be precise enough for both the agent and any institution asked to accept the document to understand what is permitted.

Limited Power of Attorney

A limited power of attorney restricts the agent to a specific transaction, purpose, or period. For example, it might cover one real estate transaction or financial responsibility while the principal is unavailable. The authority can end on a stated date or when the defined task is complete.

Durable Power of Attorney

A durable power of attorney includes language stating that the agent’s authority continues despite the principal’s later incapacity. Durability doesn’t expand the agent’s powers. The document still determines what the agent may do and when the authority begins.

Advance Health Care Directive

California uses an Advance Health Care Directive for health care decision-making. It can appoint an agent to make medical decisions when you can’t communicate and record instructions about your care. Because it is distinct from a financial power of attorney, it should address your health care preferences directly and accurately.

California Rules That Shape a Usable Document

A statutory form isn’t automatically appropriate for every person or family. The California Probate Code governs powers of attorney, but the appropriate scope, durability language, and execution requirements depend on the authority granted and its intended use.

A careful legal review should address:

  • Scope of authority: The document should identify the financial, property, or other actions the agent may take.
  • Effective date: Authority may begin immediately or upon a specified event, depending on the document’s terms.
  • Durability: If the authority should continue after incapacity, the document must include language showing that intent.
  • Execution: A California power of attorney must be properly signed and satisfy the applicable acknowledgment or witness requirements. A statutory form must be completed correctly and the principal’s signature acknowledged. Documents involving real property may also need to be notarized for recording.
  • Express powers: Creating or changing trusts, making gifts, changing beneficiary designations, or lending the principal’s property to the agent requires express authorization under California law.
  • Revocation: A principal with legal capacity may revoke or amend the authority, but parties relying on an earlier document may need notice of the change.

This authority doesn’t replace or control a will. General financial powers also don’t automatically permit gifts, trust changes, beneficiary changes, loans to the agent, or other significant transfers.

An agent may be asked to manage sensitive responsibilities during a difficult period. Trust is essential, but you should also consider the person’s reliability, availability, financial judgment, and ability to handle potential family conflict. Naming an alternate can provide continuity if your first choice can’t serve.
