Why Choose Our Probate Litigation Attorney in Folsom
When a will or trust is in dispute, you need more than someone who simply understands paperwork. You need a legal team that can manage both the legal rules and the family dynamics that often drive these conflicts. At Law Office of Tiffany L. Andrews, P.C., we focus on helping clients through emotionally charged matters, and that experience translates directly to probate litigation.
Our attorneys have decades of combined experience in California law. We are accustomed to handling disputes that involve strong emotions, complex histories, and high stakes. When you work with us, we begin by listening carefully. We review key documents, such as wills, trusts, accountings, and prior court orders, and we discuss what you know about your loved one’s wishes. We then explain how California law may apply and outline potential paths forward so you can make informed decisions about your next steps.
Our goal is to protect your interests while keeping you informed and prepared. We strive to anticipate issues before they become crises and to explain each stage of the process in plain language. If you are searching for a probate litigation lawyer in Folsom, our team is prepared to talk with you.
Common Probate Disputes We Handle in Folsom
Contested probate generally arises when someone questions how an estate is being administered or whether the planning documents are valid. You may sense that something is not right, or you may already be involved in a court dispute. In either situation, it helps to understand the kinds of issues that often require legal action.
Examples of probate disputes we can address include:
- Questions about whether a will is valid, including claims of undue influence or lack of capacity.
- Conflicts involving the interpretation of a trust or the division of trust assets.
- Concerns that an executor or administrator is mishandling estate assets or failing to provide information.
- Disagreements among siblings or other heirs about how property should be sold, kept, or distributed.
- Disputes where an earlier promise or informal agreement seems to conflict with written documents.
Every family’s situation is different, and probate disputes can intersect with prior divorces, support obligations, or long-term caregiving arrangements. Our team draws on our estate planning experience to understand the bigger picture and to help you evaluate how a contested estate may affect your financial future and your relationships.
What To Do In A Probate Conflict
When you suspect a problem with an estate, it can be tempting either to avoid conflict or to react quickly. Both approaches can put your interests at risk. Practical steps you can take now include:
- Avoid signing agreements or waivers until you understand what rights you may be giving up.
- Save emails, letters, and notices related to the estate in one secure place.
- Write down specific questions you have about distributions, asset sales, or missing information.
- Reach out for legal guidance before important court dates or deadlines pass.
When clients contact our firm, we work to clarify what is happening and what options may be available. We review the information you have, discuss how California probate rules typically apply, and help you weigh the potential costs and benefits of pursuing litigation or negotiated resolutions. Our aim is to give you a clearer picture of your situation so you can decide how to move forward.
How Local Probate Counsel Helps
For many families in this region, probate disputes are handled through the Sacramento County Superior Court probate division. Understanding how that court generally schedules hearings, reviews filings, and addresses contested matters can make a practical difference in how your case progresses.
As a firm serving this area, we are familiar with the procedures and expectations that apply when a contested estate case is filed. This familiarity helps us prepare documents in a way that aligns with local practice and anticipate the types of information the court may look for. While every judge and every case is different, understanding the local forum can make the process feel more predictable.
Working with a nearby firm can also make communication easier. Meeting in person is typically more convenient, and we can review documents together and talk through sensitive family issues in a private setting. We are also positioned to respond when new developments occur in your matter.
Probate disputes in this area often intersect with other family law issues that our firm already handles. For example, a contested estate might involve questions about prior divorce decrees, child support, or long-term caregiving arrangements. Our background in these areas helps us spot connections that might affect your overall legal strategy.
Our Approach To Probate Litigation in Folsom
Contested probate matters often unfold over many months, and sometimes longer, depending on the issues involved and court scheduling. Understanding the general path of a dispute can reduce uncertainty and help you stay focused on long-term goals. Our role is to guide you through each stage and explain how decisions at one point can affect what comes next.
While every case is different, our approach to the probate litigation process includes the following stages:
- Initial Review and Case Assessment: The process usually begins with a detailed review of estate planning documents, probate filings, and any accountings that have been provided. We also talk with you about your understanding of the decedent’s intentions and any events or conversations that may relate to capacity, undue influence, or fiduciary concerns.
- Discovery, Negotiation, and Court Involvement: Many contested probate cases involve written discovery, negotiations, and scheduled court appearances. We keep you informed about what information is being exchanged, what deadlines apply, and what strategic decisions may be approaching, so you can participate meaningfully in how the case is handled.
- Settlement Efforts or Court Resolution: In some cases, disputes can be resolved through settlement discussions or mediation, and we pursue those options when they align with your interests. When court intervention is necessary, we are prepared to present your position clearly to the probate court and advocate for an outcome grounded in the evidence and applicable law.

“Tiffany Gave Me a Voice!”
I hired Tiffany to help me in a custody dispute with my ex regarding my young son. During the entirety of my previous relationship and even after separation my ex had intimidated me and dominated any decision made regarding my son. He bullied me and used his financial advantage to make me feel that I didn't stand a chance against him when he filed to take majority custody of our son. I went into the custody dispute feeling weak but as a mother, I would go to any length, at any cost to fight for my son. Tiffany and her staff gave me so much confidence and ensured me that they would be my voice and help me fight for my rights as a mother and that is exactly what she did. Tiffany was extremely thorough, knowledgeable, compassionate, and honest. She did her job and she did it well. Tiffany was very aggressive while staying very professional in front of the judge. I walked out of the courtroom feeling empowered and protected. My family cannot ever thank her and her staff enough. I would recommend her to anyone that finds themselves in a family dispute. She will give you the justice you and your family deserve.- Cheyenne -
“Reliable”
Tiffany Andrews and her associate Mende Romaniak were extremely knowledgeable in dependency and easy to reach when I needed them. They supported any direction I wanted to take with my case and handled everything professionally and in a timely matter. I highly recommend this firm.- Heather -
“Professional and Effective”
I retained Tiffany Andrews to accomplish my divorce and am pleased with the service provided. My ex-wife was very uncooperative at times and prolonged the divorce unnecessarily. Tiffany was able to move things along and eventually get her to complete her part of the necessary paperwork. Further, I am in the military and was deployed while the process was ongoing. Even though I was half a world away Tiffany and her staff were able to keep me abreast of the situation and worked with me to sign paperwork and keep things rolling. I would highly recommend Tiffany Andrews to those in need of legal services.- Previous Client -
“Professionalism and Expertise”
Mende Romaniak has again shown both professionalism and expertise as she helped navigate me through gaining custody of my daughter. Through her hard work and concise detailing of my case not only was she able to secure sole physical custody but also sole legal custody as well. I was told more than once that gaining custody as a father is a tall order but Mende and the Law office of Tiffany Andrews came through with flying colors. I highly recommend.- Mike -
“Excellent Process and Assistance”
I'd like to thank Tiffany for her advice. I've been divorced for over a year and am still trying to collect on the settlement agreement. I had a question about the legal interest and if it's collectible and she said definitely! as long as the judgment doesn't preclude it. She was extremely helpful - also offering other remedies to assist in the collection of the funds. I would definitely call her again if I need more help.- Previous Client -
“Great Law Firm.”
Great Law Firm. They were professional and very caring to my situation. Would highly recommend this Law Firm.- Gabriel -
“Kindness and Generosity”
I can not thank me Andrews and her team enough for the kindness and generosity they showed me throughout one of the most difficult things I’ve had to deal with in my life. My head was spinning after months of googling and weighing my options while searching for a lawyer to handle my case. I imagine like most in the working class you may be afraid that you will make the mistake and hire the wrong lawyer. Wasting all your funds and end up no better off than you were. This was not the case with Tiffany and her team. I made the stupid mistake of going to the first part of my divorce custody case of going at it alone my case was very clear and I trusted the justice system to do what was right. This was not the scenario I faced. The opposition lawyer was able to manipulate everything and knew loopholes that the average person wouldn’t even believe was something that could happen in a court room. I can not stress enough it does not matter what is right and what is wrong you need a lawyer to protect yourself. As far as I’m concerned Tiffany and her team are mericle workers. I went into this thinking “oh great I’m going to be manipulated out of more and more money and I’m going to end up where I started anyway” following Tiffany’s advice I ended up being able to protect myself. From the moment I retained ms Andrews she was there for me literally day and night. I had many questions and issues throughout my case and though I don’t suggest anyone bothering her after business hours there were a few times I felt I needed to contact her and received a response very shortly after. These responses were often reassuring that she had things under control. This is a huge factor for me. Also she was very knowledgeable and always represented herself and myself in good light. I did not want to be vicious and aggressive and she managed to be assertive without being over the top. She was very respectful and I never had the feeling hat things were over my head. She always took the time to explained things to me in a way that I could understand and make well informed decisions. I would and will recommend me Andrews and her team to anyone looking for the best.- Brian -
“Amazing Family Law Attorney!!”
Tiffany did an amazing job handling my case, most of which she did long distance as I relocated to another state across the country soon after she was hired. I just couldn't have gotten through that time in my life without her. She's extremely knowledgeable and relatable. She's truly gifted at what she does and I'd recommend her to anyone with Family Law issues.- Sandrell
