Understanding Divorce Modifications in Folsom, CA
Divorce modifications are essential when life circumstances change significantly after a divorce decree is finalized. Common reasons for modifications include changes in income, relocation, or shifts in the needs of children involved. In California, modifications are generally considered when there is a substantial change in circumstances. This means the proposed change must be significant enough to affect the current agreement.
Our team at Law Office of Tiffany L. Andrews, P.C. helps clients address these changes professionally and compassionately. Familiarity with the nuances of Folsom's legal landscape allows us to provide tailored strategies that align with local expectations and legal requirements.
When we evaluate whether a modification is appropriate, we look closely at the specific orders that are in place and how the requested change will interact with California family law. For example, a substantial shift in parenting time might require a detailed review of your child’s school schedule, extracurricular activities in the Folsom area, and the practicality of transportation between households. By tying these details to the legal standard of the child’s best interests, we create a clear roadmap for how to present your request to the court.

Common Reasons to Seek a Modification
Substantial income changes are a frequent trigger for support modifications, whether you have lost a job, taken a new position with different pay, or experienced a reduction in work hours. Changes in a child’s needs, such as new medical expenses or increased costs for activities, may also justify revisiting existing orders. In other cases, a parent’s relocation, changes to work schedules, or the introduction of new caregiving responsibilities can affect the practicality of a custody or visitation plan and require the court to consider a new arrangement.
- Income and employment shifts: Sudden job loss, promotions, or changes from full-time to part-time work may affect support obligations and warrant a fresh look at the existing order.
- Child-related needs: New educational, medical, or developmental needs can change the level of support or time and attention a child requires from each parent.
- Relocation and schedules: Moves into or out of the Folsom area, changing commute times, or evolving work shifts can make an old parenting plan unworkable.
- Safety or stability concerns: If circumstances arise that call into question a child’s safety or emotional well-being, a prompt review of custody and visitation terms may be necessary.

Frequently Asked Questions
What Is the Process for Filing a Modification?
Filing for a modification involves submitting a formal request to the appropriate family court in Folsom. This process requires detailed forms, evidence of changed circumstances, and potentially attending hearings. Our firm assists with preparation, filing, and representation, helping you meet all necessary legal criteria to make a strong case.
The process typically begins with filing a motion accompanied by an affidavit outlining the changes that necessitate the modification. Once filed, both parties may be required to participate in mediation or attend a court hearing where the evidence will be reviewed. The outcome largely depends on the strength and clarity of the provided evidence. With professional guidance, you will be prepared for each step in this process.
Can Temporary Changes Be Requested?
Yes, temporary changes can be requested in some situations, particularly when urgent adjustments are needed due to immediate changes in circumstances. These temporary orders can cover aspects like temporary custody, support modification, or other significant needs. It is crucial to act promptly and engage a knowledgeable attorney to expedite such requests.
Temporary modifications are often necessary when waiting for a permanent modification would place undue hardship on one party or the children involved. The court will assess the immediate needs and consider whether granting a temporary change serves the best interests of the children or addresses urgent financial issues. Engaging an experienced legal team quickly can make a meaningful difference in such matters.
Why Is Legal Representation Important?
Handling a modification request alone can be overwhelming due to the intricacies of legal language and procedures. Attorneys provide clarity, helping you understand your options and the potential consequences of each. They also represent you in court, presenting your case effectively in pursuit of the most favorable outcome based on your circumstances. Additionally, they can help mediate between parties to find mutually agreeable solutions without involving lengthy court proceedings.

“Child & family advocate”
Tiffany is an amazing lawyer. She shines in the courtroom. I recommend hiring her for child & family law and cps dependency court cases. She is well respected in her profession and has solid knowledge of the law.- Ann -
“Peace of Mind”
Tiffany is perfect! She made herself available to me right away! She is a great listener!! I would recommend her to anyone going through custody battles and divorce.- LaCrisha -
“Excellent Process and Assistance”
I'd like to thank Tiffany for her advice. I've been divorced for over a year and am still trying to collect on the settlement agreement. I had a question about the legal interest and if it's collectible and she said definitely! as long as the judgment doesn't preclude it. She was extremely helpful - also offering other remedies to assist in the collection of the funds. I would definitely call her again if I need more help.- Previous Client -
“I feel blessed to have Ms. Andrews on my side, and I highly recommend her services!”
- CarlosAfter the initial shock of being served divorce papers, I began interviewing attorneys to help me with the legal proceedings. The first couple of attorneys focused on how to address the support and division of property issues included in the papers I was served, without really asking me about my interests in this matter.
After meeting with Ms. Andrews, and ever since that initial interview and consultation, I always felt she had my best interests in mind. She immediately explained what I needed to file and when what to expect going forward and then asked me about my interests. Wow! She was exactly the kind of attorney I was looking for to represent me.
She was always responsive to my questions and requests, no matter how basic, and got back to me in a timely manner… at times outside normal work hours. But, the biggest and most pleasant surprise to me was when she began educating and guiding me through every step in order to achieve my interests and goals -– mainly, my number one priority and “my everything” in this whole process: to retain shared custody and visitation rights with my children. Her guidance and recommendations put me at ease and really helped put my children first.
Her knowledge, honesty, and dedication through numerous and unexpected court hearings involving custody and visitation issues not only resulted in the resolution of such issues in a competent and efficient manner but a resolution that Ms. Andrews knew I wanted.
Not only is Ms. Andrews reliable, helpful and an overall amazing attorney, her office staff is also very courteous, professional and efficient in keeping me apprised of what was needed and the status of the case. Thank you so much, Ms. Andrews… and staff!!

“Amazing Family Law Attorney!!”
Tiffany did an amazing job handling my case, most of which she did long distance as I relocated to another state across the country soon after she was hired. I just couldn't have gotten through that time in my life without her. She's extremely knowledgeable and relatable. She's truly gifted at what she does and I'd recommend her to anyone with Family Law issues.- Sandrell -
“Child Custody Case”
- AlanTiffany was asked to represent me in court as my primary attorney was called to attend another court case.
Tiffany acted in a very professional manner, was very supportive, Tiffany made sure that she has a good understanding of my case prior to attending court. Whilst we waited for the court to open Tiffany was very attentive to me, asking me if I had any questions, trying to relax me even though this is a highly confrontational custody case. During the wait time, Tiffany noticed that the other attorney was acting inappropriately and immediately challenged his position, to which he apologized.
Once in court Tiffany took the lead putting forward our case, she did this in a well-structured way. Each point had solid reasoning and when the apposing council tried to interrupt Tiffany politely asked him to wait until she had completed his argument. Tiffany mentioned to the judge the incident in the waiting area and the Judge was very clear that this behavior was unacceptable. The judge listed intently to Tiffany points and contentions, the facts were very clear and he was able to make the required decisions based on her submission without further clarification on my custody request.
Despite the fact Tiffany was covering for another attorney, I could not have asked for better support. She is an outstanding attorney, very knowledgeable on custody cases and the rules relating to custody. I would have not had a second thought engaging Tiffany as my primary attorney or making a recommendation to anybody who needs an excellent divorce/custody lawyer.
Thank you for your support - you were outstanding
